Andy Oram: Regarding a national identity card, the discussion (probably in footnote 3; it doesn't seem appropriate to the main text) should be updated to cover REAL ID. Like the other examples in the footnote, it skirts the creation of an actual national ID. It's an example of the indirection you discuss elsewhere, in this case, the federal government assigning responsibility to the states.

Jyh-An Lee: More stories about law regulating code: (1) The USA Patriot and Homeland Security Acts as well as CALEA have placed numerous requirements on all service providers and law enforcement officials. Particularly lawful intercept of voice over the Internet (VoIP) and real-time Internet surveillance. (2) The FCC had mandated the implementation of the broadcast flag as a form of DRM to protect copyrighted digital content. The “broadcast flag” is a small bit of data attached to digital broadcasts. It tells devices that receive digital signals the level of copy protection. The broadcast flag would place the burden of copyright protection on electronics manufacturers of TVs, DVD players, DVD recorders, and any other device that contains a digital output.
